Terms of Service

1. Agreement
These Terms govern access to and use of SpeakBusiness, including the website, hosted application and related services. By creating an account, accessing a company account or using the service, you agree to these Terms and the Privacy Policy. If you use SpeakBusiness for a company or other organization, you represent that you have authority to bind that organization.
2. Accounts and company administration
You must provide accurate account information, protect credentials and promptly notify SpeakBusiness if you believe an account has been compromised. Company owners and administrators control team access and permissions and are responsible for the users they invite. You are responsible for activity carried out through your company account except to the extent caused by SpeakBusiness’s breach of these Terms or applicable law.
3. Free trials, subscriptions, credits and billing
SpeakBusiness’s standard free trial lasts for the period shown at signup, includes the one-time credit allowance shown at signup, and does not require a credit card. When the trial ends, company data remains associated with the account, but business access may be limited until a paid plan is selected. Before a paid subscription begins, checkout presents the plan, price, billing interval and other material terms that apply. Paid plans renew according to the billing interval shown at checkout until canceled through the available billing controls. Taxes may apply.
Paid plans may include a monthly credit allowance for voice, assistant, scanning, drafting and other assisted actions. Included monthly credits refresh with the applicable billing cycle and do not represent stored cash value. Eligible paid plans may purchase extra credits in supported dollar amounts, subject to the minimum shown at purchase; those extra credits remain available until used. If you expressly enable automatic top-ups, you authorize SpeakBusiness and its payment processor to charge the payment method you authorize for the top-up amount you select whenever your available credit balance falls below the threshold you set. You can change the threshold or amount, update the authorized payment method, or turn automatic top-ups off from Plans & billing. If an automatic charge fails or requires additional authentication, automatic top-ups may be paused until you take action. The conversion between purchase amount and credits, included allowances, action costs and plan features may change prospectively; material changes affecting an active paid subscription will be communicated as required by applicable law. SpeakBusiness may bundle related processing into one customer-facing assisted task so a single task is not interrupted solely because an internal step would otherwise exhaust the remaining balance.
If a payment fails, access to paid functionality may be limited after reasonable notice. Enterprise or separately negotiated services may be governed by an order form or additional terms.
4. Customer data and permissions
You retain ownership of business data and content you submit to SpeakBusiness, including customer records, job details, photos, notes, estimates, invoices and inventory information (“Customer Data”). You grant SpeakBusiness the limited rights necessary to host, process, transmit, back up and display Customer Data to provide, secure and improve the service. You represent that you have the rights and permissions necessary to submit Customer Data and to instruct SpeakBusiness to process it.
You are responsible for deciding what information is appropriate to place in SpeakBusiness, including information about your customers and employees, and for complying with laws that apply to your own collection and use of that information.
5. Assisted and voice features
Some features can transcribe audio, organize information, draft content, classify business details or suggest actions. Generated output can be incomplete or incorrect and should be reviewed before it is relied on, sent to a customer or used for financial, legal, safety or compliance decisions. SpeakBusiness is designed to require review for important actions where practical, but you remain responsible for decisions made through your company account.
6. Payment processing and third-party services
SpeakBusiness may connect to third-party services such as payment processors, model providers and weather-data providers. Third-party services are governed by their own terms and privacy practices. Customer payment processing may be provided through Stripe or another connected processor; SpeakBusiness does not replace the processor’s agreement with you or your customers.
7. Acceptable use
You may not use SpeakBusiness to violate law, infringe rights, gain unauthorized access, distribute malware, interfere with the service, facilitate fraud or abuse, or process content that you do not have a lawful right to use. Additional examples appear in the Acceptable Use Policy.
8. Service changes and availability
SpeakBusiness may update, add or remove features as the product evolves. We aim to keep the service available and reliable, but uninterrupted or error-free operation is not guaranteed. Maintenance, third-party outages, internet failures and events outside reasonable control may affect availability.
9. Disclaimers
To the maximum extent permitted by law, SpeakBusiness is provided “as is” and “as available.” SpeakBusiness disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement. SpeakBusiness does not provide legal, tax, accounting, employment, construction, safety or other regulated professional advice.
10. Limitation of liability
To the maximum extent permitted by law, SpeakBusiness and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data, arising from use of the service. To the maximum extent permitted by law, SpeakBusiness’s aggregate liability arising from the service will not exceed the amounts paid to SpeakBusiness for the service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Suspension and termination
You may stop using SpeakBusiness at any time and may cancel a paid subscription through the available billing controls. SpeakBusiness may suspend or terminate access for material breach, unlawful use, security risk or nonpayment, subject to any notice required by law. Where reasonably possible, SpeakBusiness will provide an opportunity to cure a breach before termination.
12. Changes to these Terms
SpeakBusiness may update these Terms from time to time. Material changes will be communicated through the service or another appropriate channel. Continued use after an updated version becomes effective constitutes acceptance where permitted by law.
